CREATIVE MEMORIES’ “BLOG HOP”
GIVEAWAY - OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. Entrants do not have to purchase any merchandise or service to enter or to win. Void in Quebec and where prohibited by law. Subject to all federal, state, provincial and local laws.
2. CAN I PARTICIPATE? The Creative Memories’ Blog Hop Giveaway is open to all residents of the 50 United States, the District of Columbia and Canada (except Quebec) age 18 years or older as of September 21, 2012. The employees (and the immediate family and household members of each) of Sponsor, its parent and affiliated companies, advertising and promotion agencies and the agents of each (“Sponsor entities”) are not eligible to win. Independent Creative Memories Consultants are eligible to participate and win. Entrants who disregard these Official Rules or the official rules of another Creative Memories’ promotion, or act in a non-sportsmanlike or disruptive manner, or otherwise annoy, abuse, threaten or harass any other participant or Creative Memories representative, may be declared ineligible and have their access to this or other Creative Memories’ sponsored promotions blocked. Sponsor entities are not responsible for printing, distribution or production errors and Sponsor may rescind, cancel or revoke this sweepstakes based upon any such error without liability and at its sole discretion.
3. HOW DO I ENTER? Enter online on 9/21/2012. Visit each blog in the Blog Hop, secure the code from each blog and complete the official entry form. Make sure you provide all the required information including your name, daytime telephone number, birthday, email address and the Blog Hop Code. One entry per person, please. All additional entries from a person will be disqualified. Entries must be received between 12:00:01 a.m. CST 9/21/2012 and 11:59:59 a.m. CST 9/22/2012. Responsibility for receipt of entry rests solely with the entrant. Sponsor entities are not responsible for late, incorrect, inaccurate or incomplete entry of information or for lost, delayed, or misdirected entries, including without limitation, entries not timely received due to telephone failures, Internet failures and disruptions, and ISP problems. Entries which are incomplete, forged or otherwise defective or made outside authorized channels will be voided. All entries become the property of Sponsor and will neither be acknowledged nor returned. Sponsor reserves the right, at its sole discretion, to cancel, terminate or suspend the sweepstakes should an unauthorized intervention or other cause beyond its control affect the administration, proper play or conduct of the sweepstakes. For a copy of these Official Rules, send a self-addressed stamped envelope to Creative Memories “Blog Hop,” c/o Channel Marketing, P.O. Box 1839, St. Cloud, MN 56302 by 3/31/2013 (VT residents may omit return postage). By entering this sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor whose decisions regarding all aspects relating to the sweepstakes shall be final.
4. WHAT CAN I WIN? Four (4) Grand Prizes. Four (4) Grand Prize winners will each receive a prize with the approximate retail value (“ARV”) of $58-$73 U.S. and $64-$79 Canadian. When entering, participants will have the option to choose a traditional or digital prize package. Limit one prize per person. No prize substitution or cash redemption allowed by winner. Prize is not transferable. All taxes on prize are the sole responsibility of the winner. Sponsor reserves the right to substitute a prize of equal or greater value if featured prize becomes unavailable. Unclaimed prizes may not be awarded. By entering, entrants release Sponsor entities and the officers, directors, employees and agents of each from any and all liability, damages, claims or causes of actions of any kind whatsoever (however named or described) for any expense, loss, injury or damage to person or property arising out of or in connection with participation in this sweepstakes or the receipt, enjoyment or use or misuse of any prize and grant permission to Sponsor entities to use their names, ages, cities, states, and photographs or other likeliness for advertising and promotional purposes without additional compensation, except where otherwise provided by law.
5. HOW DO I WIN? Winner will be selected in a random drawing from among all entries received. A drawing will take place at the completion of the contest, no later than 9/22/2012. Drawing will be conducted through random.org. Awarding of prizes will be conducted by Creative Memories Home Office. Potential prize winner will be notified by email or telephone at Sponsor’s discretion following the drawing and may be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release within 14 days of the date notice is sent or such other date set by Sponsor. In order to receive a prize, potential winners who are residents of Canada must first correctly answer, unaided, a time-limited mathematical skill-testing question which will be administered by telephone at a prearranged, mutually convenient time. Failure to correctly answer the question within the designated time will result in the potential winner’s disqualification and an alternative will be selected. If the potential prizewinner declines to accept the prize or fails to respond within the applicable time period, the prize will be deemed forfeited, and Sponsor will award the prize to an alternate winner. In the liability release, winner will agree to release Sponsor entities from any injuries, damages or losses which may be sustained in connection with ownership, use or misuse of the prize. If prize or prize notification letter is returned as undeliverable, prize will be forfeited.
6. WHAT’S MY CHANCE TO WIN? Odds of winning will be determined by the number of entries received. To learn the winners’ identities (available after 9/25/2012), send a self-addressed, stamped business size envelope to Creative Memories “Blog Hop Winner’s List,” c/o Channel Marketing, P.O. Box 1839, St. Cloud, MN 56302. All requests for the winner’s identity must be received by 3/31/2013.
7. TECHNICAL MALFUNCTIONS. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software or any combination thereof; failure of any entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
8. DISPUTE RESOLUTION. Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Minnesota; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will an entrant be permitted to obtain awards for, and each entrant hereby waives all rights to claim punitive, incidental, or consequential damages, any other damages other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the sweepstakes, shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Minnesota or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Minnesota.
9. DATA PRIVACY. Information entrants provide Sponsor will be used to communicate with entrants in relation to this sweepstakes as well as for other purposes as described in Creative Memories’ Privacy Policy. Winner’s name, age, city and state of residence may be posted on the Creative Memories’ website.
10. WHO IS THE SPONSOR? This sweepstakes is sponsored by Creative Memories, 3001 Clearwater Road, St. Cloud, MN 56301. Sponsor reserves the right to cancel the Sweepstakes at any time and substitute another promotion in its place.
